Al-Israa University Discusses Master's Thesis by Law Faculty Researcher 👉

On Monday, 20/1/2025, in Deir al-Balah, Gaza, Al-Israa University in Palestine held a Master's thesis defense for researcher Ahmed Saleh Masoud, marking a defiant step amid the harsh conditions endured by our people in Gaza. The researcher was awarded a Master's degree in Law by the Dean of Graduate Studies for his thesis titled: "Prioritizing Conflicting Lien Rights in Palestinian Legislation: A Comparative Analytical Study." The study addressed: Legal conflicts in lien rights prioritization between the Palestinian Civil Law (No. 4 of 2012) and the Palestinian Execution Law. Potential solutions to these conflicts, the court’s role in resolving them, and which law takes precedence in cases of competing claims. A comparative analytical approach to the texts of both laws. Findings & Recommendations Lien rights are ancillary to the original debt, enforceable only by legal provision—not private agreement. The study urged legislative amendments to: Clarify lien rights as accessory real rights. Grant creditors the right to trace the debt-secured property, regardless of possession.
