On Monday, 20/1/2025, in Deir al-Balah, Gaza, Al-Israa University in Palestine held a Master's thesis defense for researcher Ahmed Saleh Masoud, marking a defiant step amid the harsh conditions endured by our people in Gaza. The researcher was awarded a Master's degree in Law by the Dean of Graduate Studies for his thesis titled: "Prioritizing Conflicting Lien Rights in Palestinian Legislation: A Comparative Analytical Study." Thesis Committee Dr. Hussam al-Din Mahmoud (Supervisor & Chair) Dr. Hussein Saber al-Baba (Supervisor) (Martyr of the Gaza war, absent but spiritually present) Dr. Omar Khader Saad (Internal Examiner) Dr. Hussein Ahed Eissa (External Examiner) Attendees Dr. Nahid Hijazi, Dean of Graduate Studies Dr. Tariq al-Derawi, Dean of the Faculty of Law Dr. Munyah Mazid, Dean of Scientific Research Key Discussion Points Despite Gaza’s dire circumstances, the defense proceeded in a distinguished academic atmosphere. The study addressed: Legal conflicts in lien rights prioritization between the Palestinian Civil Law (No. 4 of 2012) and the Palestinian Execution Law. Potential solutions to these conflicts, the court’s role in resolving them, and which law takes precedence in cases of competing claims. A comparative analytical approach to the texts of both laws. Findings & Recommendations Lien rights are ancillary to the original debt, enforceable only by legal provision—not private agreement. The study urged legislative amendments to: Clarify lien rights as accessory real rights. Grant creditors the right to trace the debt-secured property, regardless of possession.
